Welcome to Navanoo Fitness. These Terms and Conditions govern your use of our services and facilities. By accessing our services, you agree to be bound by these terms. Please read them carefully.

1. Acceptance of Terms

By registering for membership, purchasing services, or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and other applicable policies.

2. Membership and Services

2.1 Eligibility

You must be at least 18 years of age to enter into a membership agreement with Navanoo Fitness. Minors between 16 and 18 may access our services with written parental or guardian consent.

2.2 Membership Types

We offer various membership options including personal training sessions, monthly memberships, and package deals. Specific terms for each membership type will be provided at the time of purchase.

2.3 Payment Terms

Payment for services must be made in advance. We accept major credit cards, debit cards, and electronic transfers. All prices are in Canadian dollars and include applicable taxes.

3. Facility Use and Conduct

3.1 Proper Use

Members agree to use equipment properly and in accordance with posted instructions and staff guidance. Any misuse of equipment may result in membership suspension or termination.

3.2 Personal Belongings

Navanoo Fitness is not responsible for lost, stolen, or damaged personal property. Members are encouraged to secure valuables in provided lockers.

3.3 Code of Conduct

Members must maintain respectful behaviour toward staff and other members. Harassment, discrimination, or disruptive conduct will not be tolerated and may result in immediate membership termination without refund.

4. Health and Safety

4.1 Medical Clearance

You represent that you are in good physical condition and have no medical issues that would prevent safe participation in fitness activities. We strongly recommend consulting with a healthcare provider before beginning any exercise program.

4.2 Assumption of Risk

You acknowledge that physical exercise involves inherent risks including but not limited to muscle soreness, strains, sprains, and in rare cases, more serious injury. You voluntarily assume all such risks.

4.3 Liability Waiver

To the maximum extent permitted by law, Navanoo Fitness, its owners, employees, and contractors shall not be liable for any injury, loss, or damage arising from your use of our facilities or services, except where such liability cannot be excluded by law.

5. Cancellation and Refund Policy

5.1 Session Cancellations

Personal training sessions may be cancelled or rescheduled with at least 24 hours notice. Cancellations with less notice may result in forfeiture of that session.

5.2 Membership Cancellation

Monthly memberships may be cancelled with 30 days written notice. Prepaid packages and annual memberships are non-refundable except as outlined in our Refund Policy.

6. Intellectual Property

All content on our website and in our facilities, including logos, text, images, and training programs, are the property of Navanoo Fitness and are protected by Canadian and international copyright laws. Unauthorized use is prohibited.

7. Privacy and Data Protection

Your personal information is collected, used, and protected in accordance with our Privacy Policy and applicable Canadian privacy legislation including the Personal Information Protection and Electronic Documents Act (PIPEDA).

8. Modifications to Terms

Navanoo Fitness reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website and will take effect immediately upon posting. Continued use of our services after changes constitutes acceptance of the modified terms.

9. Termination

We reserve the right to terminate or suspend your membership immediately, without prior notice or liability, for any breach of these Terms and Conditions or for conduct we deem inappropriate or harmful to our business, staff, or other members.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

11. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
